CTA orders Dunkin’ franchise to pay P65-M in deficiency taxes

DUNKIN DONUTS' Philippine franchise holder, Golden Donuts Inc., has been ordered to pay nearly PHP65 million in deficiency taxes by the Court of Tax Appeals (CTA).

In its 58-page decision promulgated July 30 and published on Monday, the court partially granted the petition filed by the firm and ordered it to pay PHP41.832 million but with additional fees.

The government delinquency interest rate was pegged at 12 percent per annum as of March 2015, or a total of PHP23 million to date.

The Bureau of Internal Revenue filed the complaint before the Department of Justice in 2018 for non-payment of PHP1.118 billion in income tax, value-added tax and expanded withholding tax, including surcharges and interests, for the year 2007.

Golden Donuts filed a petition in 2020 for the cancellation of the assessment, which it claimed was invalid and lacked factual and legal bases.

It also claimed that portions of some of the taxes were already barred by prescription. (Benjamin Pulta)
