NAGBABALA ANG Land Transportation Office (LTO) na hindi nito papayagan ang paggamit ng mga nutshell helmet ng mga motorcycle rider at angkas nito sa Zamboanga City dahil mahigpit itong ipinagbabawal ayon sa batas.
Mismong si LTO Regional Director Aminola Abaton ang nagsabing labag sa mga probisyon ng Motorcycle Helmet Act of 2009 o ang Republic Act 10054 ang paggamit ng nutshell helmet
May mga karampatang penalties rin ang mga lalabag sa Motorcycle Helmet Act of 2009, ayon kay Abaton.
Sa Section 7 ng Motorcycle Helmet Act of 2009 ay ito ang nakasaad: “Any person caught not wearing the standard protective motorcycle helmet in violation of this Act shall be punished with a fine of One thousand five hundred pesos (P1,500) for the first offense; Three thousand pesos (P3,000) for the second offense; Five thousand pesos (P5,000) for the third offense; and Ten thousand pesos (P10,000) plus confiscation of the driver's license for the fourth and succeeding offenses.”
Ayon kay Abaton: “The nutshell helmet is not consistent with the provisions of the Motorcycle Helmet Act of 2009 or RA 10054. Either the J-type helmet or the full-face (visor) helmet will be allowed, as it is authorized under the law.”
“The LTO fully supports the position of the National IATF (Inter-agency Task Force 0n Emerging Infectious Diseases) and the (Zamboanga) City Government and we are in sync with Executive Order 591 of Mayor Beng Climaco,” dagdag pa ni Abaton.
Ang National IATF ang siyang nag-utos sa lahat ng mga local government units sa bansa na ipatupad ang Motorcycle Helmet Act of 2009 matapos na alisin ang motorcycle barrier.
Sinabi ni Abaton na kahit noong wala pang Covid-19 pandemic ay mahigpit na ang pagpapatupad ng LTO sa nasabing batas. “Even before the Covid-19 pandemic, the LTO has been implementing the Motorcycle Helmet Act for the safety and protection of motorists, thus, the Mayor’s executive order (complying with the order of the National IATF) should be implemented by the police to the fullest,” wika nito.
Nagbabala rin ang Department of the Interior and Local Government ukol dito at sinabi ni Undersecretary Jonathan Malaya ang motorcycle driver at angkas nito ay dapat gumamit ng face mask at full-face helmet. “Both riders (driver and back rider) must wear face masks and full-face helmets at all times while back-riding to ensure compliance with minimum health standards,” paliwanag ni Malaya.
Maging ang Department of Trade and Industry sa Zamboanga ang nagsabing ang full-face helmets at J-type helmets lamang ang pinapayagang gamitin sa ilalim ng Motorcycle Helmet Act. Ang nutshell helmet umano ay para lamang sa mga gumagamit ng bisikleta at skateboard.
Sinamantala naman ng mga kalaban ni Climaco at mga black propagandist ang isyu at pilit na sinisisi ang mayor dahil sa maraming mga motorcycle driver at angkas nito ang hinuli ng pulisya at LTO dahil sa paggamit ng nutshell helmet. (Zamboanga Post)
